This website is operated by Fumba Superstore (TZ Digital Company Ltd). Throughout the site, the terms “we”, “us” and “our” refer to Fumba Superstore. Fumba Superstore offers this website, including all information, tools and services available from this site to you, the user, acting strictly as an agent, conditioned upon your acceptance of all terms, conditions, policies and notices stated here.

By visiting our site and/or placing an order, you engage in our “Service” and agree to be bound by the following Terms of Service (“Terms”), including any additional terms, conditions and policies referenced herein.

SECTION 1 – ROLE OF FUMBA SUPERSTORE 

  1. Agency Only
    Fumba Superstore acts solely as an agent on behalf of its customers. We are not the manufacturer, producer, importer, distributor, or supplier of the products displayed on this website.

  2. No Stock Holding
    Unless explicitly stated otherwise, Fumba Superstore does not hold physical stock of products listed on the website. Products are sourced from third-party suppliers, vendors, mainland Tanzania markets, and international marketplaces upon customer request.

  3. Sourcing on Customer Instruction
    By placing an order, the customer expressly authorises Fumba Superstore to source the requested products on their behalf.

  4. Availability & Refunds
    While reasonable efforts are made to source all requested items, Fumba Superstore does not guarantee that all items can be successfully sourced or delivered. Where an item cannot be delivered, a refund will be issued to the customer for the affected item(s).

SECTION 2 – GENERAL CONDITIONS

We reserve the right to refuse service to anyone for any reason at any time.
You agree not to reproduce, duplicate, copy, sell, resell or exploit any portion of the Service without express written permission from Fumba Superstore.

SECTION 3 – ACCURACY, COMPLETENESS AND TIMELINESS OF INFORMATION

Information on this website is provided for general guidance only and may originate from third-party suppliers and marketplaces.
Fumba Superstore does not warrant that product descriptions, images, pricing, or availability are accurate, complete, or current and shall not be held liable for inaccuracies originating from third parties.

SECTION 4 – MODIFICATIONS TO THE SERVICE AND PRICES

Prices are subject to change without notice due to supplier pricing, availability, logistics costs, and exchange rate fluctuations.
We reserve the right to modify or discontinue the Service at any time without notice.

SECTION 5 – PRODUCTS & SERVICES

  1. Third-Party Sourced Products
    Products offered on this website may be sourced from Zanzibar, mainland Tanzania, international marketplaces, or independent third-party suppliers.

  2. Lead Times
    Products sourced externally are subject to lead times dictated by suppliers. Once goods are in the possession of Fumba Superstore or its affiliates, delivery will be completed within a two (2) week window, unless otherwise communicated.

  3. Same-Day Delivery
    Same-day delivery refers to delivery any time within the same calendar day up to 23:59.
    Where same-day delivery is not possible, orders will automatically be fulfilled the next calendar day, unless the customer has expressly requested otherwise. Customers will be notified in advance where applicable.

SECTION 6 – DELIVERY, RISK AND HANDOVER

  1. Transfer of Responsibility
    Once products are handed over to the customer, full responsibility for maintenance, use, storage, and care transfers to the customer.

  2. Manufacturer Warranties
    Where products are covered by a manufacturer’s warranty, the customer may contact the supplier directly or purchase optional ongoing support from Fumba Superstore where available.

  3. Logistics Between Locations
    For products sourced from mainland Tanzania or international markets, any logistics, warranty, or return shipping costs between locations shall be the responsibility of the customer.

SECTION 7 – RETURNS, REFUNDS AND EXCHANGES

  1. Products may only be returned where there is a valid and justifiable reason, subject to review.

  2. Refunds and exchanges are handled at the discretion of Fumba Superstore and assessed on a case-by-case basis.

  3. Perishable goods are generally non-returnable, except where proven defective at the point of delivery.

SECTION 8 – THIRD-PARTY LINKS AND SUPPLIERS

Fumba Superstore shall not be responsible for third-party websites, suppliers, marketplaces, or their products, services, warranties, or representations. Any disputes relating to third-party products must be directed to the respective supplier.

SECTION 9 – DATA PROCESSING AND AFFILIATES

Fumba Superstore is part of TZ Digital Company Limited. Customer data may be processed and shared internally across TZ Digital Company Limited brands in accordance with applicable data protection laws and our Privacy Policy.

SECTION 10 – DISCLAIMER OF WARRANTIES; LIMITATION OF LIABILITY

All services are provided “as is” and “as available.”
Fumba Superstore, acting strictly as an agent, shall not be liable for defects, delays, failures, or losses arising from third-party suppliers, manufacturers, or logistics providers.

Where liability is established, it shall be limited to the amount paid by the customer for the affected product or service.

SECTION 11 – INDEMNIFICATION

You agree to indemnify and hold harmless Fumba Superstore, its affiliates, directors, officers, employees, and agents from any claim arising from your breach of these Terms or misuse of the Service.

SECTION 12 – GOVERNING LAW

These Terms of Service shall be governed by and construed in accordance with the laws of the United Republic of Tanzania.

SECTION 13 – CHANGES TO TERMS

We reserve the right to update or modify these Terms at any time. Continued use of the website following changes constitutes acceptance of the updated Terms.
